Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and DERYK YEO & CO (Business Registration No. 002945678-K · Firm No. AF002288), the registered business operating the AIGC brand, together with its affiliated companies AIGC Sdn. Bhd. (202401046806, Malaysia) and AIGC (S) PTE. LTD. (202607120E, Singapore) (collectively "AIGC", "we", "us"). They govern your use of our websites (aigc.com.my, aigcmalaysia.com), our AI content-generation platform, our training courses and events, and technology services we provide to businesses. By accessing or using any of our services, you agree to these Terms and to our Privacy Policy.

2. Our services

• AI content platform — AI avatar creation, voice cloning, AI video generation, script assistant, AI video editing and related content-creation tools;
• Training & events — HRD Corp-claimable courses, workshops and bootcamps;
• Business technology services — building and operating automation, messaging and marketing integrations for business clients, including integrations with third-party platforms such as products offered by Meta Platforms, Inc. (WhatsApp Business Platform, Messenger, Instagram, Facebook). Use of those integrations is additionally subject to the applicable third-party terms, including the Meta Platform Terms and WhatsApp Business Terms.

3. Accounts and eligibility

• You must be at least 18 years old (or use the services under supervision of a parent/guardian or employer) and provide accurate registration information;
• You are responsible for safeguarding your login credentials and for all activity under your account;
• Notify us immediately of any unauthorised use of your account.

4. Acceptable use

You agree not to use our services to:

• break any applicable law or regulation, including the laws of Malaysia;
• create an AI avatar or voice clone of any person without that person's explicit consent;
• impersonate any person or entity, or produce deceptive "deepfake" content presented as authentic;
• commit fraud, scams, phishing or spam — including bulk unsolicited messaging over WhatsApp, Messenger or any other channel;
• generate or distribute content that is defamatory, obscene, hateful, or that infringes intellectual-property, privacy or publicity rights;
• violate the terms of integrated third-party platforms (including Meta's policies) when using services we build or operate for you;
• probe, disrupt or circumvent the security of our systems, or resell the services without our written consent.

We may suspend or terminate accounts that breach this Section, and remove offending content, with or without notice.

5. Your content and licence

• You retain ownership of the photos, videos, voice recordings, scripts and other materials you upload ("Your Content"), and of the AI output generated from Your Content for you, to the extent permitted by law;
• You grant us a limited, non-exclusive licence to host, process and reproduce Your Content solely to provide the services you request;
• You warrant that you own or have obtained all necessary rights and consents to Your Content — including the consent of any individual whose face or voice is used;
• Your AI avatar and voice models are private to your account. We never use them for anyone else, and we do not use Your Content to train models for other customers.

6. Our intellectual property

The Platform, our software, websites, course materials, branding (including the AIGC® mark) and all related technology remain the exclusive property of AIGC and its licensors. Course materials are licensed for your personal learning use and may not be redistributed or used to run competing training without written permission.

7. Fees, credits and payment

• Prices for courses, subscriptions and credits are stated at the point of purchase; payments are processed securely by Stripe (card, FPX and other supported methods);
• Platform usage is metered in credits; consumed credits are non-refundable;
• An invoice and official receipt are issued automatically for online payments;
• We may change pricing prospectively; changes never affect amounts you have already paid.

8. Refunds and cancellations

• Platform services & credits — non-refundable once the service has been used or the generation job has started;
• Training courses — refundable if requested at least 3 days before the course start date; within 3 days of the start date, fees may be transferred to a later intake or another participant instead;
• Event cancellation by us — full refund or free transfer to the next session, at your choice;
• HRD Corp-claimable enrolments follow the applicable HRD Corp grant procedures.

9. AI-generated content disclaimer

• AI output may contain errors or artefacts and is provided for content-creation purposes only; it does not constitute professional, legal, financial or medical advice;
• You are responsible for reviewing AI output before publishing it and for how you use it, including compliance with advertising and consumer-protection law;
• Where required by law or platform policy, you are responsible for disclosing that content is AI-generated.

10. Third-party platforms

Our services interoperate with third-party platforms (Meta/WhatsApp, Google, Stripe, cloud and AI vendors). We do not control those platforms; their availability, policies and pricing may change, which can affect dependent features. Your use of a third-party platform is governed by that platform's own terms.

11. Service availability

We aim for high availability but the services are provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, and we may modify, suspend or discontinue features with reasonable notice where practicable.

12. Limitation of liability

To the maximum extent permitted by law: (a) AIGC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill; and (b) our total aggregate liability arising out of or relating to the services shall not exceed the amount you paid us for the services giving rise to the claim in the 12 months preceding the event. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify and hold AIGC harmless from claims, damages and expenses (including reasonable legal fees) arising from Your Content, your breach of these Terms, or your violation of any law or third-party right — including claims that a likeness or voice was used without consent.

14. Termination

You may stop using the services and request account deletion at any time (see our data deletion instructions). We may suspend or terminate access for material breach of these Terms. Sections 5–6, 9 and 12–16 survive termination.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision; material changes will be announced on our Sites or by email. Continued use after an update constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia, after a good-faith attempt to resolve the matter amicably.
